Politics Over the Constitution; Bolton Blew It

Arizona’s new law addressing illegal immigration, SB 1070, was partially struck down by a Clinton appointed justice, Susan Bolton.  Both common sense and a look at our Constitution support the idea that the decision was based on politics as opposed to precedent or the Constitution itself.

The LA Times writes: (emphasis is mine)

In her 36-page decision, Bolton wrote that the provisions would have inevitably “swept up” legal immigrants and were “preempted” by the federal government’s immigration authority.

Preemption has to be based on federal authority as it pertains to immigration.  Where does the federal government government get it’s authority from and what is it limited by? Specifically, the Constitution states in the tenth Amendment:

The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

The term immigration isn’t mentioned in the Constitution.  Thus it’s clear, the states never delegated the power to regulate it.  Some will argue however that under Article 1, Section 8, Congress was granted the right to regulate immigration because the states delegated the right to regulate naturalization.  This is the verbiage in the Constitution regarding naturalization:

To establish an uniform Rule of Naturalization, and uniform Laws on the subject of Bankruptcies throughout the United States;

The U.S.  Citizenship and Immigration Service says this about “naturalization”:

Naturalization is the process by which U.S. citizenship is granted to a foreign citizen or national after he or she fulfills the requirements established by Congress in the Immigration and Nationality Act (INA).

Merriam Webster’s Dictionary defines “naturalize” as follows:

1 : to confer the rights of a national on; especially : to admit to citizenship

Answers.com defines “immigrate” as follows:

To enter and settle in a country or region to which one is not native.

Clearly naturalization and immigration are two distinctly separate terms.  One refers to the movement of people and the other refers to the process of granting citizenship.   It’s also clear that Congress was delegated the power to regulate naturalization as it is clear it was never granted powers to regulate immigration.  Immigration and naturalization are related terms that have totally different meanings.  To “naturalize” is not synonymous with to “immigrate”.

Bolton’s argument that the Arizona law is unconstitutional based on “preemption” of Congress’ power to regulate immigration is fallacious.  This is because Congress was only granted the power to regulate “naturalization”.  The power to regulate immigration has always been within the purview of the states.  Furthermore, those powers have never been delegated to Congress; thus Congress lacks the power to regulate immigration as per it’s Tenth Amendment.

While this administration gives lip service to the Constitution, it continues it’s assault on it and the people governed by it’s principles and laws.  As usual with Obama and his minions, potential cheap votes and retaining power trump the Constitution, the best interests of the country and that of it’s citizens.  The only good news here is that there are only 14 weeks before we the people can do something substantial.  With all damage Obama is doing to this country at break neck speed, it is absolutely essential that he be stopped come this November.  Our collective futures depend on it.

Global warming anyone?

The Peruvian government declared a state of emergency because of the cold wave gripping a number of districts in 16 of the nation’s 24 regions, according to an urgent decree published Saturday in the official gazette.

The decree covers all districts of the country more than 3,000 meters (9,800 feet) above sea level, as well as three regions in the Peruvian jungle that have registered strangely low temperatures in the last few weeks.

According to official figures, so far this year at least 409 people have died of pneumonia and ailments related to the cold weather, most of them younger than 5 years old (200 deaths) and over 60 years (158 deaths).

The emergency declaration, which has a duration of 60 days, covers districts in the regions of Ancash, Apurimac, Arequipa, Ayacucho, Cusco, Huancavelica, Huanuco, Junin, Lima, Moquegua, Pasco, Puno and Tacna, which in recent days reached a temperature of -24 C (-11 F).

A state of emergency was also declared in the jungle regions of Madre de Dios, Ucayali and Loreto.

'Everybody Draw Muhammad Day' Advocate Rattled by Death Threats

The creator of a now-defunct "Everybody Draw Muhammad Day" page on Facebook fears she may be targeted for death now that the cartoonist who launched the online campaign has been placed on an execution list by a radical Yemeni-American cleric.

The 27-year-old Facebook page creator -- a Canadian woman who asked not to be identified due to fears of reprisal -- told FoxNews.com that she was visited at her home last week by Royal Canadian Mounted Police officials who advised her to remove her page and not to talk to reporters.This was reported on July 12th and by July 16th a new terrorist was added to a terror watch list. Now, if that helps this woman or not, I have no idea because the world is so lax when it comes to war on terror.
"I'm scared," she said. "I'm scared that somebody might kill me."

The woman created her version of "Everybody Draw Muhammad" in late April, days after a Seattle cartoonist launched the online campaign to protest Comedy Central's censoring of an episode of "South Park," in which the Prophet Muhammad was depicted wearing a bear costume. The Canadian woman said she will no longer act as the administrator of such a page.

"I just want to be quiet now," she continued. "I wish I didn't do this."As part of "Inspire," a 67-page English-language Al Qaeda magazine, Yemeni-American cleric Anwar al-Awlaki -- who has been linked to the botched Times Square bombing and cited as inspiration for the Fort Hood massacre and the plot of two New Jersey men to kill U.S. soldiers -- targeted the Seattle cartoonist for "assassination," along with others who have participated in her campaign.

WASHINGTON — The United Nations has added U.S.-born radical cleric Anwar al-Awlaki to its terrorist list, requiring member countries to freeze his assets and ban his travel.

The action follows a similar move by the U.S. Treasury Department last week, and underscores the growing threat officials believe al-Awlaki represents as a terror recruiter and planner.

Based in Yemen, al-Awlaki has taken on a greater role with al-Qaida in the Arabian Peninsula, leading to his placement earlier this year on a secret U.S. government list of terror targets to be captured or killed, according to U.S. officials.

Arizona's immigration law isn't the only one

This lawsuit should fail on the grounds the Constitution does not give the power to the federal government to make immigration laws just uniform rules of naturalization, which means citizenship even in the dictionary today. If it is not specifically stated in the Constitution it is left to the States. If you do not like what the Constitution says AMEND IT!

Colorado restricts illegal immigrants from receiving in-state tuition. Nebraska requires verification of immigration status to obtain public benefits. In Tennessee, knowingly presenting a false ID card to get a job is a misdemeanor.

Arizona's strict new law has generated the most controversy, but there are hundreds of immigration-related laws on the books across the country. The laws regulate employment, law enforcement, education, benefits and healthcare.

Already, the organization says, legislators in five states — South Carolina, Pennsylvania, Minnesota, Rhode Island and Michigan — have introduced similar bills to Arizona's SB 1070, which requires police to check the immigration status of people they lawfully stop and suspect are in the country illegally. As of last month, six resolutions had been passed in five states regarding SB 1070 — four opposing it and two supporting it. The law has prompted lawsuits, protests and boycotts.
Why is the Government not going after "sanctuaary cities"? One has to wonder...

Legend has it that his Knights would gather before battle at a round table where they would receive instructions from their King.

Obamacare's control plan? 'Behavior modification'

I am not even going to opine on this article. I just want the story to get out. Please, fax, blog and tell everyone you know about this; yet another executive order that our President has signed to destroy our way of life. Shout this article from the roof tops. Where is Thomas Paine when we need him?
President Obama has signed an executive order specifying the treatment for all Americans, to be prescribed by government bureaucrats.Obama's order appoints members to a new government committee set up by the Democrats' new health law that will evaluate, make recommendations about and establish rules for everything from how people exercise to whether they smoke to the food they eat and the medicines they use. And it specifically requires the committee list the priorities for "lifestyle behavior modification" that the government will pursue.

Administration's 'Silent Raids' Lead to Firings, Not Deportations

Yea, this administration is so much fun! They really respect the constitution and the rule of law! Whoo, Hoo!!!
The Obama administration’s new approach to dealing with companies that hire illegal immigrants results in firings, not deportations, the New York Times reported Friday.

Instead of immigration sweeps at factories and farms which used to lead to illegal workers being shipped out of the country, the administration’s new policy—government conducted audits labeled “silent raids” by employers—usually only result in the workers losing their jobs, the Times said.

The Times article comes just over a week after the president delivered his highly anticipated speech on immigration reform, which was criticized on both ends of the political spectrum.

In these audits, federal agents examine company records to find illegal workers on the payroll, forcing “businesses to fire every suspected illegal immigrant… not just those who happened to be on duty at the time of a raid,” the Times said. This makes it more difficult for companies to hire undocumented workers to fill these positions in the future, the article explained.

These audits reach more companies than the Bush raids, employers said. This year alone, Immigration and Customs Enforcement have facilitated the firing of thousands of immigrants and “levied a record $3 million in civil fines,” the Times reported.This current policy is a contrast to the Bush-era work-site roundups where undocumented employees were deported en masse. It also represents the current government opinion that treating the nation’s 11 million illegal immigrants as criminals would overwhelm the system.

First, every place in this article that they state "Immigrants" or "Illegal Immigrants" insert- "Illegal Aliens". Which is the legal term for non-citizens under our constitution. Second, how in all that is holy does this help? Where will all these displaced workers go, pray-tell? And how much money were the companies fined? Can they stay in business as a result? Don't get me wrong, I hate companies that hire illegal alien invaders, especially when there are so many Americans are out of work. But, useless raids that waste tax payer dollars and put non-citizens on unemployment is ludicrous. Cause you know that is where they are ending up. And by the by, every time a business is raided and the Illegals are ousted, Americans take the jobs that Americans do not want. Brilliant!

Mainstream Media Coverage Slim on NASA, Black Panther Stories

We did this story on our radio show; The Uncooperative Radio Show, but it has to be brought up over and over again how "Lame" the main stream media is.
From Fox News:
Charles Bolden's claim that one of the space agency's primary missions is to improve relations with Muslim countries. The other is the ongoing investigation into why the Justice Department dropped its case against New Black Panther Party members accused of intimidating voters on Election Day 2008.

"The media don't have any credibility when they don't cover the big stories," said Dan Gainor, vice president for business and culture at the conservative Media Research Center. Gainor suggested both stories appear to have all the makings of news value.

Then there is this story they are not talking about.
In the New Black Panther case, the U.S. Commission on Civil Rights is a year into its investigation and on Tuesday heard groundbreaking testimony from a former official who claims the Justice Department dropped it in part because it refuses to go after black defendants in civil rights cases.

Only a few national media outlets reported the NASA story. They included CNN and Slate -- and little else. The three broadcast networks' nightly news programs did not mention the controversy, though ABC News did run a blog on the White House response. The New York Times and Washington Post also did not carry any straight news piece on the subject. The Washington Post website, though, did carry a blurb online that linked to a FoxNews.com piece as well as an opinion blog on Wednesday. The Los Angeles Times carried a blog on Thursday, comparing the lack of media response to Wile E. Coyote waiting for his rocket pack to go off. "Silence. Nothing," the piece said.

The Black Panther coverage was a bit more robust. The New York Times covered J. Christian Adams' testimony on Tuesday, as did CNN, and The Los Angeles Times noted it briefly. The Philadelphia Inquirer provided significant coverage of the developments -- the alleged voter intimidation occurred in Philadelphia. The Associated Press ran a story on July 1 before the testimony.

The three nightly network news programs did not run the story. The Washington Post did not provide any original coverage -- it ran the July 1 Associated Press story and provided one paragraph on the case Wednesday online with a link to The Times story.

I am also finding it harder and harder to find positive news to report on our radio show. Is there anybody out there????

Wounded Warriors Face New Tax This Independence Day

As the nation prepares to celebrate Independence Day with parades and barbecues, America’s veterans face a new tax on prosthetic limbs and other vital medical devices.

The health care overhaul passed by Congress and signed into law by President Obama earlier this year contains a new tax on medical devices such as prosthetic limbs, pacemakers, and wheelchairs. This tax, which its proponents claim will raise $20 billion over the next ten years, contains no exemption for the nation’s 22 million veterans. In fact, Senate Democrats specifically refused to exempt veterans from the tax.

On March 24 2010, Senate Democrats rejected an amendment offered by Senator Orrin Hatch (R-Utah) to the healthcare bill. This amendment (SA 3644) would have prevented the medical device tax from hitting veterans covered by the Veterans Healthcare Program or TRICARE for Life. This amendment was rejected by a vote of 44-54. All but five Democrat senators voted in favor of retaining the tax for veterans.

The medical device tax was one of over twenty new or higher taxes in President Barack Obama’s healthcare overhaul. This permanent new tax is being collected now.

“On March 24, Senate Democrats had the opportunity to exempt our veterans from Obamacare’s new tax on medical devices such as prosthetic limbs. But 54 Democrats voted against the measure. They chose to side with the tax-and-spend crowd in Washington over our wounded warriors,”said Grover Norquist, president of Americans for Tax Reform. “This is one of the many reasons Harry Reid and the Democrats did not want Americans to read the 2,500 page health care bill before it was passed.”

In addition to those who served in Afghanistan and Iraq, the Department of Veterans Affairs reports the following number of veterans from America’s wars:

Six Months to Go Until The Largest Tax Hikes in History

In just six months, the largest tax hikes in the history of America will take effect. They will hit families and small businesses in three great waves on January 1, 2011:

First Wave: Expiration of 2001 and 2003 Tax Relief

In 2001 and 2003, the GOP Congress enacted several tax cuts for investors, small business owners, and families. These will all expire on January 1, 2011:

Personal income tax rates will rise. The top income tax rate will rise from 35 to 39.6 percent (this is also the rate at which two-thirds of small business profits are taxed). The lowest rate will rise from 10 to 15 percent. All the rates in between will also rise. Itemized deductions and personal exemptions will again phase out, which has the same mathematical effect as higher marginal tax rates. The full list of marginal rate hikes is below:

- The 10% bracket rises to an expanded 15%
- The 25% bracket rises to 28%
- The 28% bracket rises to 31%
- The 33% bracket rises to 36%
- The 35% bracket rises to 39.6%

Pestiferous President to Pitch Amnesty Thursday Morning « Coalition Against Illegal Immigration

The post-… partisan, racial, American (take your pick) President will be giving a “major” teleprompter reading Thursday morning. TOTUS will be helping the man who can read like few others attempt to sell poison to the populace. The poison will, of course, be presented as a necessary cure. This should not pose much of a challenge for the presidential teleprompter, which seems to be the only thing in this administration that works well. The source of all the President’s orations is well-practiced at putting a bow on a pile of equine fecal matter and making it appealing to a majority of the electorate.

This particular “major” reading is purely political and aimed at paying off one specific group of supporters. This group among whose leadership includes the detestable Rep. Luis Gutierrez (D-La Raza), is none other than the ‘open borders’, ‘amnesty for illegals’, ‘what can American citizens give you?’ group.

It is noble of President Obama to take time from his golfing schedule to address his subjects on one of his many harmful goals. The need for urgent amnesty is so great, the President has decided to give a “major” reading when he could be otherwise occupied blocking the oil clean up or trying to convince Europe that his new economic way (their old economic way) is the best economic way.
