Supreme Court sends back ruling on Janet Jackson

Wow, I didn't even know this was still going on. Did you?

WASHINGTON — The Supreme Court ordered a lower court Monday to reconsider its decision tossing out a fine against CBS for Janet Jackson's exposed breast during the Super Bowl halftime show in 2004.

In a brief order, the justices sent the case of the "wardrobe malfunction" back to the appeals court in light of a related high-court decision last week. That decision, in a case involving expletives uttered by Cher and other celebrities, upheld the Federal Communications Commission's sanctioning of broadcast TV for even the one-time use of expletives related to sexual or excretory functions.

The justices took no position Monday on the merits of the FCC's effort to reinstate a $550,000 fine against CBS. Their action, however, gives the agency another chance in the Philadelphia-based U.S. Court of Appeals for the 3rd Circuit to justify its indecency order against the network

I guess the Supreme Court didn't want to "view", I mean "touch", no wait I mean consider taking on this issue huh? This is one time that the government has the right to regulate something. When it's "public airways", subsidized by the public. Why NPR is allowed to go on is beyond me. And many have tried to squash that puppy.

This is one of the many reasons Cable TV and now Satellite TV came into being. To make money and give the folks an alternative. Ah good old capitalism. It will be interesting to see how this will turn out.
