California electoral vote split proposed

Wouldn't this be great!

From The Washington Times:
A prominent Republican lawyer wants to put a proposal on the California ballot next year that could shake up the 2008 presidential contest to his party's advantage.

California awards its 55 electoral votes to the statewide winner — the largest single prize in the nation. But under the proposal, the statewide winner would get only two electoral votes. The rest would be distributed to the winning candidate in each of the state's congressional districts. In effect, that would create 53 races, each with one electoral vote up for grabs.

The state voted Democratic in the past four presidential elections. But the change — if it qualifies for one of two primary ballots early next year and is approved by voters — would mean a Republican would be positioned the following November to win about 20 electoral votes in Republican-leaning districts. That is a number equal to winning Ohio.

The Presidential Election Reform Act is being pushed by Thomas Hiltachk, a lawyer in a Sacramento firm that represents the California Republican Party and worked with Gov. Arnold Schwarzenegger. He did not return phone messages left yesterday at his office. A Schwarzenegger spokeswoman said the governor is not involved with the proposed initiative.
democrats are, of course, opposed to this idea as it would mean that republican and independent conservative voters would have a say in California as to who is President. I bet voter turn out would increase as well. Right now we all know where California's electoral vote will go, to a Democrat. I would like to see this idea spread. there is nothing like seeing the majority of a state's counties vote one way and because one county has a big city in it the State's vote goes the opposite way.

It would also mean that candidates would campaign in California which they do not bother to do right now.

Maine and Nebraska now allocate electoral votes by congressional district.

Spencer Abraham, no way in Hell, Fred Thompson.

Cross posted from Right Truth:

Fred Thompson has been my favorite for President in the 2008 election, until now. If what I'm hearing about Spencer Abraham, Thompson's new campaign manager, then Fred's campaign is dead in the water. Spencer Abraham, according to reports, is a supporter of open borders. That by itself is enough to turn most conservative voters off. On top of the border security question, I'm hearing that Spencer Abraham is an apologist for the Islamists. No way Fred can get elected if this is true. No way in hell.

Are you not aware that immigration restrictionists loathe Abraham as an open-borders true-believer, and that your appointment of him as your most important staff person throws into doubt your main selling point as a candidate? Did you have a reason for doing this, or are you just thick? (LibertyPost.com)

Michelle Malkin mentioned Spencer Abraham in her book "Invasion":

In my 2002 book Invasion (p. 71, 76), I noted the open-borders obstructionism of former Sen. Spencer Abraham (R-Michigan), who fought to block the implementation of two different tracking databases–one for foreign student visa holders and the other for all temporary visitors (which was mandated by Section 110 of the 1996 Illegal Immigration Reform and Immigrant Responsibility Act). Abraham led efforts to starve the first database of funding and crusaded several times to kill Section 110 altogether. On September 11, 2001, neither of those databases was in place. To this day, they remain incomplete.

Texas Fred asks, "Reason for Concern?? Speak your mind and let us know". Indeed, let Texas Fred know what you think, but more important ... let Fred Thompson know what you think. I have already sent letters to the campaign telling them Spencer Abraham must go, or Fred Thompson had NO chance of winning the election.

The American Muslim Alliance praises Spencer Abraham via Babbazee at The Outraged Spleen of Zion in a comment at Texas Fred's. And from the Islamic Free Market:

“The future of the Islamic Free Market Institute will no doubt reach new heights under Saffuri’s strong leadership. ” Sen. Spencer Abraham, Michigan

I'm keeping an open mind. Some readers at Texas Fred's think this is a strategic move by Fred to win votes, others think it is a fatal mistake, while others don't see any problem with Abraham. Time will tell as more information comes out.

The Senate Passes $3 Billion in Emergency Funds for Border Security

Of course, keep in mind, that HR 2638 will still need to be agreed to by the House and signed by President, but the extra $3 billion for border security is a step in the right direction.  Securing the border is the first step that our leaders must take to show the nation that they are serious in their efforts to choke off illegal immigration.

Whether this is just more smoke and mirrors or the realization in Washington that the dreams of amnesty are dead will only only be determined by a substantial decrease in illegal immigration.  CQ has the story:

After a flurry of negotiations, the Senate on Thursday agreed to add $3 billion in emergency border security funding to the fiscal 2008 homeland security spending bill, drawing Congress closer to a confrontation with the president over the level of funding in the bill.

The amendment, offered by Lindsey Graham, R-S.C., was adopted by 89-1.

The Senate was moving toward passage by late Thursday or Friday a $37.6 billion spending bill (HR 2638) that exceeds President Bush’s request by $2.3 billion and would provide $177 million more than the House-passed version. The White House on Wednesday threatened to veto the bill in its current form because of what it characterized as excessive spending.

Senate Majority Leader Harry Reid, D-Nev., and Sen. John Cornyn, R-Texas, worked out an agreement that led to adoption of the Graham amendment.

Graham said the $3 billion in emergency spending would fund an additional 23,000 Border Patrol agents, 300 miles of vehicle barriers, 105 ground-based radar cameras in the desert and completion of the 700 miles of physical border fencing authorized by Congress last year .

Judge supports hiring and renting to illegals!

The citizens of Hazleton, PA were dealt a blow by one of the greatest allies a criminal can have, a judge. I was disappointed, but not shocked, to read an article from Reuters via Drudge.

Court throw’s out city’s illegal immigration law

U.S. District Judge James Munley said the city of Hazleton, 100 miles north of Philadelphia, was not allowed to implement a law that would fine businesses that hire illegal immigrants and penalize landlords who rent rooms to them.

“Federal law prohibits Hazleton from enforcing any of the provisions of its ordinances,” Munley wrote in a 206-page opinion following a federal trial in which Hazleton’s law was challenged by civil rights groups.

It is difficult to imagine how some judges sleep at night. This judge’s action against righteousness isn’t as grotesque as the disgusting act of Judge Katherine Savage, who dismissed the case of child rape against Liberian native Mahamu Kanneh because n interpreter who spoke his West African dialect could not be located, however this ruling may have a nationwide effect. This precedent could be used to prevent other local governments from enacting and enforcing laws that punish those that hire and rent to illegal aliens.

The struggle against illegal immigration is obviously more than building the Hunter Fence, even though that would be a wonderful start! The struggle is against the politicians who, for a variety of unjust reasons, seek to bestow legal status on those who are now here and those who would come here illegally. The struggle is against those greedy employers that continue to hire illegals and those anti-sovereignty (for lack of a better descriptive term) judges that enable these employers.

The common sense steps that would go a long way toward facilitating the natural attrition of illegal aliens within our borders are rendered useless by the actions of those entities mentioned above. These types of rulings should serve as proof that our government has become too cumbersome and the bureaucracy seems to damage our nation as much or more than it proves useful!

Mexican-Chinese drug lord arrested

It's being called the "world's largest seizure of drug cash" ever. The man, Zhenli Ye Gon, arrested on drug and money-laundering charges" and accused "of importing enough chemicals into Mexico to make $724 million worth of methamphetamine, mostly destined for the U.S."

July 24 (Bloomberg) -- Mexican-Chinese businessman Zhenli Ye Gon was arrested on drug and money-laundering charges by U.S. authorities, who accused him of importing enough chemicals into Mexico to make $724 million worth of methamphetamine, mostly destined for the U.S.

Ye Gon was arrested in the Maryland suburbs of Washington last night, the U.S. Drug Enforcement Agency said today.

The arrest follows a March raid on Ye Gon's Mexico City home in which Mexican authorities found $207 million in cash, the biggest seizure ever of suspected drug money. Mexican traffickers supply at least 80 percent of the methamphetamine consumed in the U.S., according to the DEA.

``We've apprehended not only the man behind the money, but the man behind the meth,'' DEA Administrator Karen Tandy said in a statement.

The U.S. and Mexico began joint efforts to combat methamphetamine trafficking last year, and the DEA helped train more than 2,000 Mexican police officers.

Update: Price's Legislation to Ensure Deportation of Criminal Aliens

I contacted Rep. Price, Democrat from North Carolina, who sponsored legislation to require ICE to keep track of alien criminals in local jails.  His office emailed me back with the following information:

This direction to ICE is included in the Fiscal Year 2008 Homeland Security Appropriations bill, H.R. 2638, which passed the House in June.  See page 41 of the Committee report accompanying H.R. 2638, which provides more details (Link here: Report)The Senate is expected to consider its version of the bill this week, and we hope to have agreement on a final bill that both the House and Senate can approve by mid-September.

Here is the text of the proposed law:

PRIORITIES ENFORCING IMMIGRATION LAWS

The Committee is concerned that, as ICE increases its interior enforcement efforts as part of the Secure Border Initiative, the agency is losing perspective on which aliens represent the most significant threat to the nation’s social and economic fabric. The Committee questions why a significant number of illegal aliens serving sentences in State and local correctional facilities after conviction for various non-immigration crimes are still released from custody

without efforts made to deport those who are deportable. According to ICE estimates, approximately 630,000 foreign nationals are currently serving criminal sentences in U.S. prisons and jails, yet in 2005 ICE identified and deported only 79,000 of these individuals, leaving approximately 551,000 criminal aliens who have yet to be identified and processed for removal from the country. While estimates vary, many who analyze this problem believe a significant number of criminal aliens are released back into society after completing their sentences, rather than being processed for removal from the country.

CRIMINAL ALIEN PROGRAM

The Committee allocates $180,009,000 for the ICE Criminal Alien Program (CAP), which is $14,000,000 more than the amount requested and an increase of $42,515,000 above the 2007 enacted level. The Committee strongly encourages ICE to ensure that all incarcerated aliens eligible for deportation are removed from the country upon their release. Toward that end, the Committee includes statutory language requiring ICE to collect information from

every jail, prison and detention facility in the United States on a monthly basis to determine the population of incarcerated aliens, and to develop a plan to remove every removable alien upon their release from the corrections system. According to the Bureau of Prisons, nationwide there are approximately 1,500 Federal and State correctional institutions, and another 3,500 locally-administered jails. While contacting all of these facilities on a regular basis will require coordination and effort on the part of the agency, ICE has more than 8,000 employees who work on domestic investigations and who could help with this effort. The Committee directs ICE to report no later than January 1, 2008, on how it will meet this goal, the need for additional resources to do so, and its successes and challenges in working with State and local corrections managers.

Macy's catering to Hispanics backfires

Macy's campaign to cater to Hispanics is called "Brown is the New White." The new line of clothing, (including t-shirts that say "I is for illegal", and more that are so repulsive I cannot print it here), has been rejected by Hispanics, calling the line "offensive." Macy's is now removing the merchandise from shelves.

The shirt — part of a clothing line exclusively aimed at Latina shoppers looking to express cultural identity through fashion — reads "Brown is the New White," across the chest.

Macy's apologized for its decision to sell the shirt, and released a statement.

"We are constantly looking for unique and differentiated merchandise that will resonate with our customers as hip, current and trendy. We also continue to work in developing business relationships with minority vendors to serve the growing diverse customer base. We apologize if customers have found some of the merchandise offensive and have removed the style that they found objectionable." (Fox)

Hispanic marketing expert Dr. Ed Rincon said:

"Macy's doesn't know a whole lot about what Hispanics want in the way of clothing. It also says that Macy's doesn't understand Hispanic culture. More importantly, it says that Macy's doesn't understand the Hispanics that lives in the U.S. and the kinds of products they are looking for." (AHN)

From hummers and cigarettes:

I dunno ... it was hip to sell "It's a Black thing. You wouldn't understand." I saw Jeeps with the window sticker "It's a Jeep thing. You wouldn't understand." Can I have a t-shirt that says "I'm White. Can you explain it to me again?" Or, how 'bout: "I'm White and I'm Sorry!"

From WackBag:

As a white man I find this offensive, but Macy's doesn't give a shit about us, because the assumption is that whites are allowed to be offended.

From Mi blog es tu blog

As for myself, I’m still stunned… $24.95 for a crummy Made-in-El Salvador T-Shirt? you gotta be kidding me!

On illegal aliens and crimes that make you say, "WHAT???", read "Some Animals Deserve to Be Hunted Down For The Good Of Society" at Chicago Ray. Here's a taste:

And this case discussed below involves one of those people. This incredible situation involves the repeated rape of a young girl who is a relative of the defendant by a lying cheating foreigner granted asylum here in the US, whom in spite of schooling all the way through college played our court system like a bongo drum by falsely claiming he cannot speak English well enough to receive a fair trial, thus requiring an rare interpreter for an even rarer language that apparently only he and 100,000 Sierra Leone pygmies speak.

Years of physical and emotional torture, scars that may never be healed. The judge should be removed.

Law Enforcement WORKS

Happy Monday, everyone! Finals are over, new classes have started, and now it's time to get back to business...

Today I want to focus on how SB529 is affecting Georgia and its illegal immigrant population. Two things I have personally noted since the new laws have gone into effect:

- Car sales are taking a hit now that illegal immigrants cannot get vehicle tags without proper identification.
- More 'Now Hiring' signs going up for local businesses.

Let's see what the news media is reporting:

Rumor has it that many illegal immigrant families in Georgia are planning to leave the U.S. by December and it looks as if the new employee verification processes are starting to have an effect on the illegal immigration population.

Georgia businesses are starting to evaluate their hiring practices so they will be in compliance with SB529, and so their business does not become the next target on ICE's hit list.

Also in Georgia, some local counties have taken illegal immigration matters into their own hands by requiring any company that bids on their construction projects to have legal employees. Gwinnett county has received a small backlash from business owners, but commissioners are downplaying the issue saying that most business owners understand the county's decision.

Interestingly, big agricultural businesses who regularly hire illegal immigrants are having no problems with keeping a steady stream of employees. In fact, it has been nearly three weeks since SB 529 has been in effect, and there is still a surplus of illegal immigrant workers available to the industry.

Regardless, the new laws and their enforcement seem to be working, and I suspect the surplus mentioned above will start to dwindle as more illegal immigrants find it harder to obtain personal transportation.

Now, if we could just get the open borders advocates to understand that enforcing the law is neither racist, nor xenophobic, we'll be in great shape...

**POLITICS**

In political news, Georgia Senators Chambliss and Isakson are continuing to urge the President to supply emergency funding for the Mexican/American border fence that was passed last year...(which still isn't built...) We know that the letter will likely fall on deaf ears, but at least the Senators are expressing what their constituents would like to see happen.

Until next time, folks...

The New Republic's "Shock Troops": Fact or Fiction?

I smell a rat...

From the Weekly Standard:
The New Republic runs a piece in this week's issue titled "Shock Troops" (sub. req.) and authored by Scott Thomas--described by the magazine as a "pseudonym for a soldier currently serving in Baghdad." "Thomas" is the author of two previous dispatches from Iraq for the New Republic, both of which recount deeply disturbing anecdotes (in one, an Iraqi boy who calls himself James Bond has his tongue cut out for talking to Americans; in the other, dogs feast on a corpse in the street). His latest piece is even more disturbing. It recounts several instances of gross misconduct by the men in his unit, some of which are, to echo the title of his piece, deeply shocking--If they are true--a big if, according to several people with experience in Iraq. One described it to me as sounding like a "pastiche of the 'This is no bullshit . . . stories soldiers like to tell."
Go and check out all the stories, but so far no one can corroborate one fact in his writings. The Weekly Standard asked the blogosphere to help at getting at the truth, especially the Milbloggers, So far, still nothing to back up this writers outrageous claims.

Is Bush Getting the Message on the Fence?

Cross posted from The Virtuous Republic

Maybe, just maybe, the incredible pressure being brought to bear on the Bush administration is finally paying off. It seems Chertoff is finally going to start building the border fence. Of course, Americans still need to remain skeptical and only the finished fence will be proof of our government's commitment to securing our southern border.
Construction on a border wall in southern Texas is expected to begin by this autumn, despite strong local opposition, U.S. Homeland Security Secretary Michael Chertoff said in an interview published on Thursday.

Chertoff told the Houston Chronicle the federal government "can't rule out" using powers of eminent domain to seize land for the wall that is intended to stem the flow of illegal immigrants entering the United States from Mexico.

In heavily Hispanic southern Texas, where cultural and economic ties to Mexico run deep, local officials, business groups and environmentalists have spoken out against the wall as unnecessary and unwanted.

But Chertoff said national security was at stake, so the project will move ahead shortly.

"I expect we'll be doing some construction in Texas this fiscal year," he said, referring to the government fiscal year ending September 30.

Local officials said recently they had been told the Homeland Security department plans to have 153 miles of wall in place in Texas by the end of 2008.

Liberal Group Calls Dems' Vote to Boost Abstinence Funds 'Cynical'

Who let the loons out?

From CNS NEWS:
A liberal youth group has criticized House Democrats for passing an appropriations bill last week that included a $27.8 million increase for "failed abstinence-only-until-marriage programs."

"With friends like these, who needs conservative Republicans?" asked James Wagoner, president of Advocates for Youth.

"In one spectacularly cynical move, the Democrats turned their backs on science-based public health and chose political expediency over the health and well-being of young people," Wagoner said in a statement after the House passed the bill by a 276-140 vote on Thursday.

Wagoner, whose group says its function is to "help young people make safe, responsible decisions about their sexual and reproductive health," stated that "Democrats who have been ardent critics of abstinence-only voted to increase the very programs they opposed when Republicans controlled the Congress."
Well science based loon, there is only one 100% way to prevent from getting sexually transmitted diseases and unwanted pregnancies and that is NOT HAVING SEX! There is no other SCIENTIFIC way of preventing it 100%. Now does this mean we should not teach teens about STDS and show pictures of what it will do to them if they get them? No, I encourage scaring the hell out of them! Does that mean you do not discuss the contraceptives legally available to them if they decide to live dangerous sexually permissive lives? No, but it does mean I do not want you teaching SEX to the kids. This includes encouraging them to experiment with homosexuality. We need to do all we can to protect our kids by discouraging sex before adulthood and yes, marriage. does this mean they are all going to listen? No, but many will and even if only one listens it is worth the effort. Do I want these to be federally funded programs? No, the state should decide for themselves what they wish to teach and pay for it themselves.

That said, these people overlooked an awful lot.
Wagoner also pointed to a 10-year congressionally mandated evaluation of the program, released last April.

The report, carried out by a policy research group called Mathematica, found that "youth in the [abstinence-only] program group were no more likely than control group youth to have abstained from sex and, among those who reported having had sex they had similar numbers of sexual partners and had initiated sex at the same mean age," he said.[snip...]

Christensen also found it odd that the group cited the Mathematica report in its news release but failed to mention that in the same study, "comprehensive programs showed no reduction in teen STD [sexually transmitted disease] rates or teen pregnancy rates - so it showed that those programs weren't effective, either."

As a result, "these guys seem more anti-abstinence than they are interested in actually preventing the spread of STDs or teen pregnancies," he charged. [snip...]

He noted that the measure "also increases Title X family planning funding by $28 million to over $310 million total, and it includes a new item for $10 million in comprehensive sex ed programs through the CDC [Centers for Disease Control and Prevention]."

Christensen said the Senate version of the appropriations measure "did gut the abstinence education program by cutting its funding and redefining it," though the bill must still undergo the conference committee process. Therefore, "it remains an open question as to whether the Democrats can produce a bill the president will sign."

President Bush has promised to veto the bill as it stands now, because it spends about $10 billion more than he requested.

As Cybercast News Service previously reported "comprehensive" sex education receives as much as 12 times more government funding than its abstinence-only counterpart.
and that is thee rest of the story...

Judicial nominations and the Constitution

Correction: All references to Missouri in the quoted CNS article should say Mississippi

Here we go again...

From CNS News:
Twenty years after President Ronald Reagan's failed nomination of Judge Robert Bork to the Supreme Court, another fight is brewing in the U.S. Senate over a judicial nominee - this time, over Leslie Southwick, a nominee to the Fifth Circuit Court of Appeals.

Southwick's nomination is to a seat - previously held by Judge Charles Pickering - that has been declared an "emergency vacancy." Pickering faced opposition from Senate Democrats and was recess-appointed by Bush in 2004. He withheld his name for consideration for another attempt at confirmation and retired from the bench when his term expired.

The American Bar Association has unanimously ranked Southwick as "well-qualified" for the Court of Appeals.

But as Cybercast News Service reported earlier, a number of liberal groups oppose Southwick, accusing him of bringing conservative views into his court rulings.

The controversy stems from two cases Southwick became involved with, one regarding the use of a racial slur in a workplace and the other dealing with the parental rights of homosexuals.

Though Southwick did not write the opinions, in a May 30 letter to the members of the Senate Judiciary Committee, People for the American Way President Ralph Neas stated that "the opinions that a judge chooses to join, or elects not to, can be just as revealing of his judicial philosophy as those that he writes."

Neas added that Southwick "may lack the commitment to social justice progress to which Americans are entitled from those seeking a lifetime appointment to the federal bench."
One can only HOPE he lacks commitment to "social justice". A judge is supposed to apply the law as intended by the legislators, not apply "social justice". There it is one of my three deadly words for our country social justice, diversity and political correctness.
In Richmond vs. Missouri Department of Human Services, the Mississippi Appellate Court Southwick ruled that a white state employee should not be terminated for derogatorily referring to an African-American co-worker.

The racial slur was made outside of the recipient's presence, she later made an apology that was accepted, and the workplace was not significantly disrupted. The Mississippi Supreme Court concurred with the result of the decision of Southwick's courts but found that more detailed reasoning for its conclusions was required.
sounds perfectly reasonable to me, what ever happened to free speech under the First amendment?
Neas said that Southwick's decision "effectively ratified a hearing officer's opinion that the slur was only 'somewhat derogatory' and was in effect calling the individual a 'teacher's pet.'"
What? How did this idiot equate this ruling with saying it is like calling someone a teachers pet? But you know what, what difference does it make what derogatory word you call someone and why should some words and some people be treated differently? What ever happened to the concept of "sticks and stones will break my bones, but names will never hurt me"? Now all I here is words hurt! We have become such a weak, self centered society. Now we want judges to say if you call someone a name, or you hurt my
FEELINGS, you have to be punished! This is more Left wing lunacy that wants hate speech laws in this country. Learn the Constitution people PLEASE, the first Amendment is designed to protect against such nonsense.

So what did Southwick have to say?
In his hearing before the Senate Judiciary Committee, Southwick called the term "always offensive," "inherently and highly derogatory,' and that there was "no worse word."
Yup it is an offensive word, unless a black person uses it of course.
The second case, S.B. vs. L.W., Neas says that the Mississippi Court of Appeals repeatedly used "gratuitously anti-gay" terminology in describing lesbians. The court awarded custody of a child to its biological father rather than its mother, who was living with a woman in a homosexual relationship.
A gratuitously "anti-gay" phrase? I wonder what that could be?
The term in question, "homosexual lifestyle," has been used in previous decisions ruled by both the Missouri and U.S. Supreme Courts. The court also considered a variety of factors in awarding custody to the father, including the quality of the father's job and residence, his income and his roots in the community.
Now we cannot use the term "homosexual lifestyle"? Maybe we should just call it perverted or queer? Political correctness is going to destroy our society.
Last Tuesday, Sen. Arlen Specter (R-Pa.), ranking member of the Senate Judiciary Committee, took to the floor to urge senators to move forward with the nomination. Specter said Southwick had "an impeccable record" and called him "a mild-mannered professional who is a confident man" and "a solid lawyer" who "has been a solid judge."

But at the Judiciary Committee business meeting two days later, Chairman Patrick Leahy (D.-Vt.) lambasted his Republican colleagues for backing Southwick.

"This is not a partisan fight that needs to be waged," Leahy said. "We can work together to fill this Fifth Circuit vacancy. I hope the president and Senate Republicans will work with us."

No vote was held on Southwick at Thursday's meeting.
Here go the democrats again blocking judicial nominations. Leahy wishes to steal the power of judicial appointments from the executive branch. Congress seems to think they are the Roman Senate! Don't let that pesky Constitution get in your way Leahy, just tell the uninformed massses it means something different than the people who created says it means. "Advise and Consent" Does not mean the Senate gets to tell the President who to appoint! It means you can advise the President on people you would like to RECOMMEND, the President makes his choice and you CONSENT to ANY qualified judge. This is a real dangerous game they are playing, we have too many open judicial seats and if both parties go down this road it will only get worse. The Republicans nominated almost 400 of Clinton's judicial nominees and most of them they did not like for their political ideology. Frankly no "liberal judge" should be appointed anywhere. By definition of how liberal judges behave on the bench they are unqualified to be judges. They tend to legislate from the bench., not apply the law equally and in the way the legislators who wrote the law, or Constitution intended. Noah Webster (the founder responsible for article I, section 8, paragraph 8 of the Constitution wrote. In the lapse of two or three centuries, changes have taken place which...obscure the sense of original languages...The effect of these changes is that words are... now used in a sense different from that which they had... [and thus] present a wrong signification or false ideas. Whenever words are understood in a sense different from that which they had when introduced... mistakes may be very injurious. #1

As you can tell he is warning us that words change in meaning over time and we must understand people's words at the time they were written, not based on their meaning today. This was back in the 1800s and our language has changed much more dramatically over the centuries than back then.

But let us look at what other had to say:

James Wilson, an original justice on the Supreme Court: The first governing maxim in interpretation of a statute is to discover the meaning of those who made it. #2

Justice Joseph Story (appointed by President James Madison): The first and fundamental rule in interpretation of all is to construe them in according to the sense of the teerms aand intentions of the parties. #3

To avoid such "injurious mistakes" President Thomas Jefferson admonished Supreme Court Justice William Johnson:

On every question of construction, carry ourselves back to the time when the Constitution was adopted, recollect the spirit manifested in the debates, and instead of trying what meaning may be squeezed out of the text, or invented aginst it, conform to the probable one in which it was passed #4

James Madison agreed:
I entirely concur in the propriety of resorting to the sense in which the Constitution was accepted and ratified by the nation. In that sense alone it is the legitimate Constitution. And if that be not the guide in expounding it, there can be no security for a consistent and stable, more than for a faithful, exercise of it's powers... What metamorphosis would be produced in the code of law if all its ancient phraseology where to be taken in its modern sense. #5

I saved the two best for last, as you can see the "Liberal/Progressive" concept of a living breathing document that changes over time is completely false, as is interpreting the legislators laws anyway they chose to view and apply them.

You now have some tools to combat this cancerous way of thinking. We need true constructionist judges that we call Conservative.

I'm Baaack!

Well, sorta...

As you might of noticed I started posting again. We are up on the mountain and I have got my satellite dish tuned in. I have purchased the required equipment and learned to do it myself. I am sure that does not surprise anyone who knows me, as I like to be self sufficient. I will not be as prolific as usual as I am very busy up here getting ready for winter which is coming very soon. strange because this is one hot summer here, so maybe it will give me some extra time; but I won't count on it.

Well, off to see what I can post today!

The 'Plame Game' Has Reached Endgame

Hot air has the story about how the civil case filed by plame and wilson is dead, dead, dead! Now if they would just disappear from the public square. As I have stated in the past, THERE WAS NO CRIME COMMITTED. She was not covert as described in the law. She did not have to leave the CIA as she did nothing there that required her to hide her identity. Wilson lied in his op-ed and Plame committed perjury in the Congress. Both are democrat party people and this was all about politics.

Now shut up and disappear...

Sex Ed for Kindergarteners 'Right Thing to Do,' Says Obama

Oh, this is just peachy...

From ABC News:
ABC News' Teddy Davis and Lindsey Ellerson Report: Sen. Barack Obama, D-Ill., told Planned Parenthood Tuesday that sex education for kindergarteners, as long as it is "age-appropriate," is "the right thing to do."

"I remember Alan Keyes . . . I remember him using this in his campaign against me," Obama said in reference to the conservative firebrand who ran against him for the U.S. Senate in 2004. Sex education for kindergarteners had become an issue in his race against Keyes because of Obama’s work on the issue as chairman of the health committee in the Illinois state Senate.

"'Barack Obama supports teaching sex education to kindergarteners,'" said Obama mimicking Keyes' distinctive style of speech. "Which -- I didn’t know what to tell him (laughter)."

"But it’s the right thing to do," Obama continued, "to provide age-appropriate sex education, science-based sex education in schools."
The democrats/socialists want your children folks and they use the public school system to indoctrinate them. This is not anything new really, some public schools are using a book called the prince and the prince to teach children as young as kindergarten age about homosexuality. Children this young should not be thinking about sex at all and if they are normal and left alone they won't be. Teaching children to questionn their sexual orientation is ludicrous!

I don't know how anyone can trust their children to public schools any longer.

Illegal Immigration Alert: It’s BAAAAACK!

Cross posted from Common Sense America

What do our elected officials do when they don’t get their way on the issue of amnesty for illegal aliens? They simply piecemeal the amnesty bill and try to sneak it into other bills. They think we won’t notice.

Yeah, right!

This week, The Dream Act will rear its ugly head as Senator Dick Durbin tries to insert it into our Defense Authorization Bill. On Friday, Durbin stated:
What I tried to do several years ago was to write a law to take into consideration these young people. It is called the DREAM Act. The DREAM Act was a part of this comprehensive immigration reform bill. Here is what it says: If you came to the United States before the age of 16, if you have lived in this country for at least 5 years, if you graduate from high school, and then if you will complete either 2 years of college or 2 years of service in the military, we will give you an opportunity for legal status in America.

Durbin announced that he would be offering the Dream Act as an amendment this week:
On the floor of the Senate, when we return next week, we will resume consideration of the Defense authorization bill. It turns out that many in the Department of Defense believe, as I do, that the DREAM Act is an important part of making certain we have talented young men and women ready to serve in our military. I have spoken to people at the Department of Defense who support the idea of the DREAM Act. I think we ought to include it in the Defense authorization bill. I hope to have that opportunity. [snip]

I hope when we return to the Defense authorization bill we can make the DREAM Act part of that bill. Certainly, it is going to help our defense and help our military. I think it is going to help America even beyond that. [snip]

Mr. President, as I said, I rise to speak about legislation known as the DREAM Act, which I hope to offer as an amendment to the Defense authorization bill.

And Durbin goes on to say how much Americans need these illegal aliens - our military will crumble without them, ahem, well, at least according to Durbin:
Some people might ask why the Senate should revisit immigration again and whether an immigration amendment should be included in the Defense authorization bill. The answer is simple: The DREAM Act would address a very serious recruitment crisis that faces our military.

Under the DREAM Act, tens of thousands of well-qualified potential recruits would become eligible for military service for the first time. They are eager to serve in the Armed Forces during a time of war. And under the DREAM Act they would have a very strong incentive to enlist because it would give them a path to permanent legal status.

Trying to hide amnesty for illegal aliens in the Defense Authorization bill by pretending that it is necessary for our Department of Defense and our military is a bunch of hooey and we all know it.

And, of course, Durbin then goes into a chorus of “they are only here to do the job that Americans won’t do” as he cites a survey that compares Hispanics to Caucasians:
The DREAM Act doesn’t mandate military service. A student who is otherwise eligible could earn legal status by attending college. It would be inconsistent with the spirit our volunteer military to force young people to enlist as a condition for obtaining legal status.

But the DREAM Act creates a strong incentive for military service. And many DREAM Act kids come from a demographic group that is already predisposed towards military service. A 2004 survey by the Rand Corporation found that 45 percent of Hispanic males and 31 percent of Hispanic females between ages 16 and 21 were very likely to serve in the Armed Forces, compared to 24 percent of White men and 10 percent of White women.

Ok, that’s Dick Durbin’s spin on the Dream Act but let’s get a few thoughts from a person that actually possesses a bit of sanity and wisdom…

Kris Kobach wrote an article for The Heritage Foundation after the Comprehensive Immigration Reform Act of 2006 (S. 2611) was passed by the U.S. Senate about this amendment in which he explains that the Dream Act has less to do with our military and a whole lot to do with a general amnesty:
The DREAM Act is a nightmare. It repeals a 1996 federal law that prohibits any state from offering in-state tuition rates to illegal aliens unless the state also offers in-state tuition rates to all U.S. citizens. On top of that, the DREAM Act offers a separate amnesty to illegal-alien students.

It also gives amnesty to ten states that openly violate Federal law, Kobach writes:
Events of the past 10 years illustrate how the DREAM Act would undermine the rule of law. In September 1996, Congress passed the landmark Illegal Immigration Reform and Immigrant Responsibility Act (IIRIRA). Led by Lamar Smith (R–TX) in the House of Representatives and Alan Simpson (R– WY) in the Senate, Congress significantly toughened the nation’s immigration laws. To his credit, President Bill Clinton signed the bill into law.

Open-borders advocates in some states — most notably California — had already raised the possibility of offering in-state tuition rates to illegal aliens who attend public universities. To prevent such a development, the IIRIRA’s sponsors inserted a clearly worded provision that prohibited any state from doing so unless it provided the same discounted tuition to all U.S. citizens:

“Notwithstanding any other provision of law, an alien who is not lawfully present in the United States shall not be eligible on the basis of residence within a State (or a political subdivision) for any postsecondary education benefit unless a citizen or national of the United States is eligible for such a benefit (in no less an amount, duration, and scope) without regard to whether the citizen or national is such a resident.”

Members of Congress reasoned that no state would be interested in giving up the extra revenue from out-of-state students, so this provision would ensure that illegal aliens would not be rewarded with a taxpayer-subsidized college education. The IIRIRA’s proponents never imagined that some states might simply disobey federal law.

But, according to Kobach, that didn’t stop some of the states:
The majority of state legislatures had the good sense to reject the idea, but eight states followed the examples of California and Texas, including some states in the heart of “red” America. Today, the 10 states that offer in-state tuition to illegal aliens are California, Illinois, Kansas, Nebraska, New Mexico, New York, Oklahoma, Texas, Utah, and Washington.

In most of these states, the law was passed under cover of darkness because public opinion was strongly against subsidizing the college education of illegal aliens at taxpayer expense. The governors even declined to hold press conferences or signing ceremonies heralding the new laws.

Under the “cover of darkness” - sound familiar? What our constituents don’t know, won’t hurt us … or so they think.

But in-state tuition isn’t the only ‘gift’ in the Dream Act that Koback found:
This amnesty opens a wide path to citizenship for any alien who entered the country before the age of 16 and has been in the country for at least five years. As with the rest of the Senate bill, the guiding notion seems to be “The longer you have violated federal law, the better.”

Beyond that, all the alien needs is a high school diploma or a GED earned in the United States. Alternatively, he need only persuade an institution of higher education in the United States—any community college, technical school, or college—to admit him.

The DREAM Act abandons any pretense of “temporary status” for the illegal aliens who apply. Instead, all amnesty recipients are awarded lawful permanent resident (green card) status. The only caveat is that the alien’s status is considered “conditional” for the first six years. To move on to the normal green card, the alien need only obtain a degree from any institution of higher education, complete two years toward a bachelor’s degree, or show that doing so would present a hardship to himself or his family members. Of course, an alien with a normal green card can bring in family members and seek citizenship.

Furthermore, the DREAM Act makes it absurdly easy for just about any illegal alien — even one who does not qualify for the amnesty — to evade the law. According to Section 624(f), once an alien files an application — any application, no matter how ridiculous — the federal government is prohibited from deporting him. Moreover, with few exceptions, federal officers are prohibited from either using information from the application to deport the alien or sharing that information with another federal agency, under threat of up to $10,000 fine.

Thus, an alien’s admission that he has violated federal immigration law cannot be used against him — even if he never had any chance of qualifying for the DREAM Act amnesty in the first place. The DREAM Act also makes illegal aliens eligible for various federal student loans and work-study programs.

What part of NO don’t these clowns understand? The American people have angrily tried to shout down amnesty and public benefits to people who illegally enter this country but Durbin and Company continue to try to spend our tax dollars on it anyway.

It is typical for our elected officials to betray us by taking parts of failed legislation and attaching them to legislation that they know will pass.

This has to be stopped now or the amnesty bill we just succeeded in killing will be resurrected and passed - piece-by-piece.

We are going to have to watch these guys like a bunch of two-year-olds. I’ve got to tell you, friends, I sure get tired of babysitting them and I hope we elect some adults in 2008.

No Pardon Promise for Ex-Border Patrol Agents

CNSNews.com) - President George W. Bush Thursday praised the federal prosecutor who was grilled two days earlier by a Senate panel for his role in the conviction of two U.S. Border Patrol agents for the shooting a drug dealer.Taking questions from members of the Nashville, Tenn., Chamber of Commerce after a speech, Bush declined to promise to pardon the two agents, as a growing number of lawmakers are urging."I'm not going to make that kind of promise in a forum like this," Bush said. "Obviously I am interested in facts. I know the prosecutor very well, Johnny Sutton. He's a dear friend of mine from Texas. He's a fair guy. He is an even-handed guy."Sutton has a long association with the president. Between 1995 and 2000, he served as then Texas Gov. George W. Bush's criminal justice policy director. Before he was appointed to the post of U.S. attorney, Sutton served as a policy coordinator in the Bush-Cheney transition team when the president was first elected.
